Difference between Torrens and Strata subdivision


Torrens

Torrens subdivision creates separate lots under separate ownership. There is no shared ownership or Strata Body Corporates for Torrens Title. Torrens lots however may be burdened with easements and restrictions such as a common (party) wall, drainage easement and rights of access which permit owners of other lots to undertake certain activities within the extents of the easements/restrictions.


Strata - General

Strata subdivision creates shared ownership of common areas and sometimes structures on the strata lots, under the management of an owner’s corporation. The owner’s corporation is responsible for management of the strata in line with the relevant legislation, including;


Annual Reporting is required via the Strata Hub. More information can be found here. The requirements for all strata schemes are similar, with the exception of detached dual occupancies.

Where the owners agree, the buildings are physically detached and no part of a building is outside of it’s own lot, the owners corporation may choose;


An exemption can be entered during the annual reporting process. All other management obligations required for strata development remains and is the responsibility of the owner’s committee.
